The franchise relationship is a complex one and is usually central to the success or failure of the franchisor and franchisee's business. When problems arise, a timely resolution is of critical importance. Mediation works best when the parties have a number of interests in common and is especially effective when the parties see a need to work with one another or cooperate in the future. Because each of the parties to a franchise agreement expects to enjoy a long standing and mutually profitable business relationship, the mediation process is ideally suited to resolving controversies arising in this setting.
